The bill modifies existing education law by mandating that local educational agencies obtain superintendent or principal approval before allowing ICE personnel into school facilities. When access requirements are met, ICE officers must restrict their presence to areas where students are not present. The legislation extends these same protections to child care centers, requiring director approval and limiting ICE access to spaces without children.
Under the measure, school superintendents and principals must report any ICE requests to access school grounds to their governing boards while maintaining confidentiality of potentially identifying information. The bill preserves existing provisions prohibiting schools from collecting immigration status information about students or families except when required by law or necessary for administering state/federal education programs. Local educational agencies must continue providing parents information about students' rights to education regardless of immigration status and educating pupils about impacts of immigration-related bullying.
The Commission on State Mandates will determine whether these new requirements constitute state-mandated costs requiring reimbursement to local agencies and school districts under existing Government Code provisions.
