Senator Pérez's education privacy legislation would require California schools and colleges to notify their entire campus communities when immigration enforcement officers are present on their grounds. Under the proposed changes, K-12 schools must inform all teachers, staff, parents, guardians and other school community members when immigration enforcement presence is confirmed on campus. Similarly, public colleges and universities, along with qualifying private institutions, must alert their students, faculty, staff and campus communities about confirmed immigration enforcement activities.
The bill maintains current prohibitions on schools collecting information about students' and families' citizenship or immigration status, except as required by law or to administer state/federal education programs. It preserves requirements that school leaders report immigration enforcement requests for campus access to their governing boards while protecting confidentiality. Educational institutions must continue following protocols for emergency contacts before involving child protective services when a student's guardian is unavailable.
For higher education, the measure retains existing protections around personal information disclosure and requirements to assist undocumented students in maintaining financial aid eligibility and other benefits if impacted by enforcement actions. Institutions must still provide free access to immigration legal services information and adopt policies limiting assistance with enforcement activities as outlined by the Attorney General.
