Assembly Member Schiavo's proposal to regulate contracts between counties and transitional housing providers for foster youth would establish mandatory 10-year initial terms while preserving county flexibility to modify or end agreements. The legislation applies to both traditional transitional housing placement providers serving foster youth age 16 and older and Transitional Housing Program-Plus providers supporting former foster youth who have aged out of the system.
Under the proposed framework, counties would retain authority to terminate contracts or specific services before the 10-year period expires by providing 90 days' notice to providers. The bill also permits counties and contractors to mutually agree on contract extensions, either during the initial agreement or at any point thereafter. These provisions apply to organizations currently licensed by the Department of Social Services as well as county-certified Transitional Housing Program-Plus providers who have obtained local fire clearance.
The measure includes fiscal provisions specifying that any resulting cost increases for local agencies beyond existing 2011 Realignment Legislation mandates would require annual state funding. New programs or enhanced services implemented by local agencies above funded levels would not trigger additional state reimbursement requirements under the California Constitution.
