Assembly Member Nguyen's proposal to modify California's plastic bulk container regulations would require recycling businesses to collect email addresses when purchasing or transporting five or more containers used for milk, eggs, or bottled beverages.
The measure adds email addresses to the existing proof of ownership requirements, which currently mandate collection of the seller's name, address, telephone number, and signature. Businesses must continue verifying seller identity through government-issued photo identification and maintain these records for one year from the transaction date. The proposal retains the existing misdemeanor penalty for violations of these requirements.
The documentation rules apply to any person or entity engaged in recycling, shredding, or destroying plastic bulk merchandise containers, as well as those transporting containers for these purposes. While the measure creates additional recordkeeping obligations by expanding the scope of required seller information, it includes no state reimbursement to local agencies for associated costs since the changes relate to misdemeanor enforcement.
