Assembly Member Ramos proposes designating Native American Day as a paid holiday for California state employees, elevating the current observance held annually on the fourth Friday in September. The measure modifies state employee compensation rules for holiday work while maintaining existing provisions for alternative holiday selections and schedule adjustments.
Under the legislation, state employees working on Native American Day would receive straight-time pay plus eight hours of holiday credit. For excluded employees eligible for overtime under federal law, the bill provides time-and-a-half pay for holiday hours worked, along with up to eight hours of holiday credit. Those ineligible for overtime would receive holiday credit and informal time off. Part-time employees would receive prorated benefits according to departmental guidelines.
The bill retains current provisions allowing state employees to elect holiday credit for Lunar New Year, Genocide Remembrance Day, or Juneteenth in place of personal holiday credit. It also preserves existing rules for holiday observance when dates fall on weekends, with most Sunday holidays observed the following Monday and November 11 holidays falling on Saturday observed the preceding Friday. For State Bargaining Unit 5, the measure maintains separate holiday provisions while incorporating the Native American Day changes.
